Australian crypto firms requiring financial-services authorization have until September 30 to comply with regulatory requirements or face enforcement action, the Australian Securities and Investments Commission (ASIC) announced this week.

Qualifying digital-asset businesses must take one of four steps by the deadline: apply for or vary a financial-services license, become an authorized representative, notify ASIC of an intended market-license application, or begin winding down operations.

Starting October 1, firms that require authorization but have not met the applicable conditions will lose the benefit of ASIC's temporary no-action position. The regulator warned that breaches of financial-services law can result in civil and criminal penalties, including fines of up to 10% of annual turnover.

Regulatory Framework Determines Eligibility

The deadline does not apply uniformly across the crypto sector. Whether a business falls within the licensing regime depends on whether the digital asset or arrangement qualifies as a financial product and what service the company provides.

Businesses providing financial services involving qualifying digital assets can apply for an Australian Financial Services License, vary an existing license, or operate through authorized-representative arrangements. Market operators and clearing and settlement providers must notify ASIC in writing of their intent to apply and attend a pre-application meeting by September 30, with a formal application due within 12 months.

The no-action policy excludes several products, including crypto lending and earn offerings, most digital-asset derivatives, and certain non-cash payment facilities.

Extension and Enforcement Timeline

ASIC originally set a June 30 deadline, then extended the transition by three months and broadened available compliance routes. The regulator has recorded more than 45 applications for relevant digital-asset financial-services authorizations since updating its guidance in October 2025.

Companies that do not wish to enter the licensing system can wind down instead, provided they notify ASIC by September 30 and cease covered activities within the permitted period.
