The Independent Community Bankers of America (ICBA) has filed a lawsuit against the Office of the Comptroller of the Currency (OCC), alleging that the agency exceeded its statutory authority by granting national trust bank charters to cryptocurrency and financial technology firms.

Under the Donald Trump administration, the OCC has granted conditional national trust bank charters to several firms, including Ripple, Circle, Paxos, Fidelity Digital Assets, Revolut, and World Liberty Financial. These approvals allow the companies to provide nationwide asset custody and settlement services while remaining exempt from Federal Deposit Insurance Corporation (FDIC) insurance requirements for consumer deposits.

Concerns Over Fair Competition and Stability

The ICBA argues that the exemption enables crypto firms to enter the banking system via lightly regulated national charters instead of undergoing traditional, rigorously regulated bank charters. According to the banking group, this creates unfair competition for community banks and poses risks of financial market instability. The lawsuit asks the court to vacate the "Final Rule" and Interpretive Letter 1176, which granted the OCC powers to issue the national trust bank charters.

Crypto Industry Response

Crypto advocacy groups and industry representatives have pushed back against the legal action. The Digital Chamber argued that crypto firms sought regulation appropriate to their business models rather than evading oversight. Jonathan Gould of the OCC previously rejected similar claims from banks, stating that his role is not focused on incumbent protection.

Alexander Grieve, Vice President of Government Affairs at Paradigm, criticized the lawsuit as an effort by traditional banking trades to protect their positions at the expense of consumers. Policy watchers note the legal challenge could potentially stall modernization efforts surrounding crypto custody rules, creating a complex regulatory balancing act as the government weighs traditional banking interests against the scaling of stablecoins and digital assets.
