California lawmakers have passed a bill that restricts the involvement of public officials with memecoins, driven by concerns regarding potential conflicts of interest and pay-to-play arrangements.

According to Legiscan data, the California Senate approved Assembly Bill 2409 in a 40-0 vote. The Assembly later concurred with the Senate's amendments in a 78-0 vote. Having entered the enrolled stage, the legislation now awaits action by the governor.

If enacted, the measure will bar digital asset service providers from offering California residents memecoins issued on or after Jan. 1, 2027, that are created by or in partnership with federal, state, or local public officers. The legislation defines memecoins as digital assets whose value stems primarily from public interest, speculation, or community engagement.

The legislative action comes amid broader scrutiny of political figures and cryptocurrency ventures. A recent report by the nonprofit consumer advocacy organization Public Citizen indicated that investors in the US president-linked Official Trump (TRUMP) memecoin face an estimated $3.2 billion in unrealized losses. CoinMarketCap data shows the token holds a market capitalization of $688 million, making it the fifth-largest memecoin, following recent weekly gains that recovered some of its prior annual decline.

Separately, cryptocurrency ventures associated with the Trump family have created hurdles for the passage of the US crypto market structure bill, known as the Digital Asset Market Clarity (CLARITY) Act. Reports indicate that a private bipartisan ethics addendum could allow Donald Trump to defer capital gains taxes on mandatory divestitures, potentially resulting in millions of dollars in tax savings.
