CFTC Chair Selig Raises Regulatory Questions About Autonomous AI Agents in Crypto Markets

Commodity Futures Trading Commission Chairman Michael Selig said autonomous AI agents managing money, trading assets, and launching cryptocurrency tokens raise novel regulatory questions for the agency. He made the comments Wednesday at the CFTC's first Frontier Forum in Washington, DC.

Selig described a scenario where autonomous systems could manage financial tasks without traditional intermediaries. "It's no longer science fiction to imagine your refrigerator autonomously purchasing your groceries with funds that it earned from staking ether or launching a meme coin," he said. He noted that his remarks represented his personal views and did not necessarily reflect those of the Commission.

Growing Use of AI Tools in Finance

Selig noted that AI tools are becoming nearly as common as web browsers in financial services. He cited Claude, ChatGPT, and Gemini as examples of applications that can integrate with other software to analyze market data. Some brokerages are beginning to offer these tools to customers, and individuals are providing AI agents access to bank and brokerage accounts to manage finances.

Blockchain technology enables agents to hold and trade cryptocurrency without banks, brokers, or other intermediaries. An eToro survey published in September found that 79% of US millennial investors and 77% of Gen Z investors used or were open to using AI for investment decisions.

Regulatory Challenges

Selig highlighted that CFTC rules were designed around "identifiable market participants," creating gaps when applied to autonomous software. He posed key questions for regulators: "Does the developer of that agent become subject to registration? Who is liable if the agent goes rogue?" He also suggested the possibility of "know-your-agent" checks for autonomous trading systems.

The chairman warned that agents could react to market conditions in unpredictable ways. Agents built on similar models might trade in similar patterns, and their speed could complicate market surveillance. Similar concerns have been raised elsewhere. The Bank of England's Financial Policy Committee warned last year that widespread use of similar models could amplify market shocks.

Potential Benefits and Agency Response

Selig noted that the technology could provide smaller traders and businesses access to risk management tools previously available only to large firms. He added that CFTC staff already use AI to monitor markets.

Selig referenced an earlier CFTC proposal, Regulation Automated Trading, which followed the 2010 Flash Crash. The Commission never finalized it, and he said it would be ill-suited for current market conditions.

Cryptocurrency exchanges are already deploying agent tools. Coinbase launched Agentic Wallets in February, allowing agents to spend and trade within user-set limits. Binance launched AI Agent Skills in March to provide market data and tools for spot orders.

The CFTC requested public comment on compute derivatives earlier this year, which could allow firms to hedge computing power costs. Selig said the agency received more than 100 responses and intends to take the opportunity seriously.
