The agency is utilizing its existing authority under Section 2(c)(2)(D) of the Commodity Exchange Act. According to the announcement, the regulatory push is designed to stop abusive practices, establish clear standards for common industry operations, and explore a dedicated crypto-specific market registration category.

Focus on Retail Leverage and Margin Risks

The proposed framework centers on retail commodity transactions that utilize borrowing or leverage, which can expose users to rapid financial losses and counterparty risks. CFTC Chairman Michael S. Selig stated that the process aims to provide clarity and consumer protections while functioning as part of a broader federal market-structure agenda.

The commission is seeking public input on several key areas:

  • Methods to prevent abusive practices across crypto markets
  • Clearer disclosures and compliance practices tailored to digital assets
  • Identification of established industry practices that deserve formal regulatory treatment
  • Registration expectations for margin products on crypto exchanges

Limitations and Next Steps

While the initiative could establish clearer compliance expectations for platforms handling leveraged trading, the proposal does not create blanket federal oversight for every token trade. Simple, fully paid spot purchases do not automatically fall under the retail commodity transaction provision, leaving ordinary cash trading outside this narrow scope. Additionally, the Securities and Exchange Commission maintains separate responsibilities for crypto assets that meet securities-law tests.

The rulemaking remains at an early consultation stage. Public comments must be submitted within 60 days following publication in the Federal Register. Formal rule text and implementation timelines will depend on the feedback received from market operators, investors, and consumer advocates.
