Ripple CEO Brad Garlinghouse stated that leaders at the Commodity Futures Trading Commission agree the existing rulebook for the crypto industry is outdated following the agency's first-ever Innovation Advisory Committee meeting.
The August 20 meeting included the 35-member committee, CFTC Chairman Michael Selig, and featured a regulatory posture distinct from the enforcement-first approach of the agency's past. Garlinghouse, who joined the committee in February, described the gathering as a sign that Washington is moving toward regulatory clarity.
CFTC Chairman Selig directed agency staff to explore using existing regulatory authorities to build a structured framework for crypto markets. This contingency plan was triggered because the Digital Asset Market Clarity Act, which aims to establish clear jurisdictional lines between the CFTC and the SEC, remains stalled in the Senate.
Passing the Clarity Act requires 60 votes in the Senate, a threshold complicated by partisan divides. Selig acknowledged that without legislation, the industry faces ongoing uncertainty and potential enforcement actions for participants operating in regulatory gray areas.
Garlinghouse highlighted a shift in tone among CFTC leadership, emphasizing that regulatory clarity is necessary for deploying financial technologies at scale. Although the committee meeting did not produce specific market-moving announcements, proposed rules, or timelines, it signaled that the CFTC is aiming to act as a proactive regulator rather than a reactive enforcer.
