Circle CEO Says GENIUS Act Has Bipartisan Durability Despite Election Uncertainty

Circle CEO Jeremy Allaire contends that the GENIUS Act, which establishes federal rules for payment stablecoin issuers, is unlikely to face reversal regardless of shifts in congressional control. His reasoning centers on the vote margins that passed the law: 102 House Democrats and 18 Senate Democrats voted in favor when it was enacted.

Allaire made the argument during a CNBC interview on October 21, 2026. The GENIUS Act was signed into law on July 18, 2025, after clearing the Senate 68-30 and the House 308-122.

The wide bipartisan support, Allaire suggested, creates political friction around full repeal. Lawmakers would need to undo their own votes to reverse the measure, a particularly difficult position for Democrats who supported it initially. Allaire also framed the law as beneficial for US dollar strength through formal recognition of digital dollar issuance.

OCC Rules Set Concrete Standards

On the same day as Allaire's comments, the Office of the Comptroller of the Currency released final rules implementing the GENIUS Act. The rules establish requirements for payment stablecoin issuers, including reserve standards, redemption timelines, custody protocols, and capital ratios.

The central requirement mandates full 1:1 reserves: every stablecoin in circulation must be backed by an equivalent asset held in reserve. The rules also restrict payment stablecoin issuance to permitted providers only.

Both the OCC rules and the GENIUS Act reach full effectiveness on January 18, 2027. Issuers have until that date to prepare compliance systems.

Circle's Position

Circle issues USDC, one of the largest dollar-backed stablecoins. USDC circulation reached $73.3 billion in Q2 2026, representing 19% year-on-year growth. Allaire indicated that regulatory certainty from the GENIUS Act framework positions USDC favorably compared to other digital asset sectors still awaiting comparable clarity.

Broader Implications

Stablecoins are crypto tokens pegged to stable values, primarily the US dollar, and serve functions including trading, payments, and cross-border money transfers. For years, issuers operated without dedicated federal oversight. The GENIUS Act established the first comprehensive federal framework defining who can issue payment stablecoins and under what operational conditions.

For issuers, compliance with the 1:1 reserve requirement and expedited redemption rules becomes the near-term priority. Issuers unable to meet these standards will not be permitted to operate in the US payment stablecoin market.

Allaire's argument addresses the risk of complete reversal rather than potential amendments or incremental tightening. Even with bipartisan support, future congresses could pursue modifications to the framework or heightened oversight without achieving full repeal.
