If digital asset activity migrates to offshore venues with looser regulatory standards, he argues, Washington loses visibility into financial flows, sanctions enforcement weakens, and rivals like China gain influence over emerging global financial standards.

Legislative Timeline and Vote Dynamics

H.R. 3633 passed the House with 294–134 support in July 2025. The Senate Banking Committee advanced it 15–9 in May 2026, with two Democrats crossing party lines. Senate Majority Leader John Thune filed a cloture motion on August 8, setting the September 15 procedural vote. Coinbase Chief Policy Officer Faryar Shirzad confirmed the date publicly.

The cloture vote requires 60 votes to proceed, meaning Republican support alone is insufficient. Remaining disputes include ethics restrictions on officials' crypto holdings, bank lobbying over stablecoin yield rules, and illicit-finance provisions.

Market and Policy Stakes

Investors are closely tracking the September 15 date, as passage of a statutory framework differs substantially from agency-by-agency regulation. CFTC Chair Michael Selig has pledged that crypto rules will advance regardless of CLARITY's fate, but agency-built frameworks carry reversal risk after elections. A statutory win is considered more durable.

The White House has restated its full commitment to September passage and previously convened a crypto summit with SEC and CFTC leadership to accelerate the bill's path forward.
