Lithuania Tightens Crypto Tax Reporting Rules Under EU's DAC8 Directive

Lithuania has tightened rules on how crypto companies report their users to tax authorities. On September 24, 2026, the country's State Tax Inspectorate (VMI) issued Order No. VA-63, updating its crypto reporting regime under the European Union's DAC8 directive.

The new order amends an earlier set of rules, Order VA-119, issued on December 10, 2025. Less than a year later, the tax authority clarified reporting obligations for crypto-asset service providers and operators.

Key Changes

The order introduces three significant updates: new definitions for reportable persons, streamlined registration processes, and updated due diligence requirements.

Providers must collect and submit user identities, tax residencies, account balances, and details on transactions exceeding $50,000 equivalent. They must also maintain records of user identification and transaction logs for tax purposes.

The reporting requirement covers entities operating inside the EU as well as selected non-EU residents. Annual reports are due by May 31 each year, with the first deadline on May 31, 2027, covering data from calendar year 2026.

Relief for Compliant Providers

Providers that are fully compliant with reporting obligations in another EU member state can, under specific conditions, avoid duplicate reporting in Lithuania.

Additional Requirements

Starting March 2027, certain custodial or transfer activities will require authorization as electronic payment services. Lithuania's capital gains tax rate on virtual assets remains unchanged; the updates focus on reporting transparency rather than new taxation.

EU-Wide Coordination

DAC8, formally Directive 2023/2226/EU, extends automatic information sharing between national tax authorities to cover crypto-assets. Lithuania's changes align with both DAC8 and the OECD's Crypto-Asset Reporting Framework.

The full EU-wide automatic data exchange is scheduled to begin in mid-2027. Key dates include March 2027 for payment services authorization requirements and May 31, 2027, for initial annual reports and registration notices.
