The SEC has clarified its approach to classifying digital assets under federal securities law, using the classic Howey test to determine when crypto assets and token sales constitute securities. The agency emphasized that classification focuses on economic reality rather than terminology, with assets falling under securities regulation if investors anticipate profits driven by the managerial effort of founders.
Notably, the SEC confirmed that buybacks and liquid staking do not convert commodities into securities, a clarification that generated optimism in the market.
PUMP's Market Response
PUMP rebounded sharply following the SEC's statement. The token recovered from a low of $0.0038, reclaimed and flipped the $0.004 level, and rallied to a daily high of $0.0046. At the time of reporting, PUMP traded at approximately $0.0045, representing an 18% daily gain. The price movement was accompanied by a 57% increase in spot trading volume.
Capital Flows and Buyback Activity
The positive sentiment triggered fresh capital inflows into the PUMP protocol. According to DefiLlama, USD inflows reached $24 million, reversing a four-day declining trend that had recently turned negative.
The project continued its token buyback program, spending $1.6 million to purchase 398 million tokens after generating $3.2 million in revenue. To date, the team has bought and burned $463.79 million worth of PUMP, equivalent to 16.79% of total supply removed from circulation.
Selling Pressure Observed
Despite ongoing buybacks reducing available supply, aggressive selling activity persisted. On September 26, spot sell volume reached 2.68 billion tokens while buy volume fell to 2.54 billion, creating a buy-sell delta of -144.5 million. Exchange data showed positive spot netflow for three consecutive days at $1.49 million, indicating continued profit-taking despite the rally.
Technical Indicators
Technical analysis showed mixed signals. The Trend Strength Index formed a bullish crossover and rose to 6.8, while the Aroon OSC held around 42 for two consecutive days, suggesting stabilizing upside momentum. However, active profit-taking presented downside risk to the rally's continuation.
