The Senate blocked the Clarity Act on Tuesday in a procedural vote, failing to reach the 60-vote threshold required to advance the legislation. Senators voted 49 in favor and 50 against the long-awaited bill that the digital asset industry has championed.
The Clarity Act seeks to formally divide regulatory oversight of digital assets, establishing which assets should be classified as securities, commodities, or stablecoins. The bill previously passed the House of Representatives but stalled in the Senate during 2026.
Opposition came from both sides of the aisle. Democratic Senator Elizabeth Warren, a prominent critic of the crypto industry, argued ahead of the vote that the legislation "posed a massive risk to families" and would expose the U.S. to "a crypto-fuelled economic crash." Warren stated that the nation still needed more comprehensive crypto regulation.
A key concern raised by Warren and other lawmakers centered on potential conflicts of interest. A revised draft circulated in July included an ethics provision barring the president, vice president, members of Congress, federal judges, and their spouses from issuing or sponsoring digital assets for compensation. A subsequent draft granted state attorneys general enforcement authority alongside the Justice Department.
Despite the legislative setback, federal regulators continue developing rules for the digital asset industry. The banking sector has also been involved in ongoing disputes with crypto companies regarding stablecoin yield offerings to customers.
