Swedish tax authorities are intensifying scrutiny of data center operators in the country's north, challenging hundreds of millions of kronor in VAT deductions and reshaping the region's computing landscape. The disputes pit the classification of crypto mining against computing services—a distinction with significant tax implications as mining companies transition to AI infrastructure.

The Swedish Tax Agency has issued proposed VAT decisions against subsidiaries of Northern Data AG and secured appellate rulings against two Swedish units of HIVE Digital. Both companies argue their facilities provided computing capacity or infrastructure services to identifiable customers, while the tax authority contends that at least some activity constituted crypto mining, which falls outside the VAT system and therefore does not support equipment deductions.

Impact on Business Operations

The tax enforcement is reshaping capital deployment decisions. HIVE has directly linked its decision to phase down crypto mining in Sweden to the tax disputes and associated enforcement measures. Northern Data's shift from cryptocurrency mining to AI-cloud and data center operations has followed the company into its broader corporate transformation.

Northern Data faces particularly significant exposure. In September 2025, investigators searched company-related premises in Frankfurt and Swedish cities, resulting in arrests during an investigation into suspected large-scale VAT fraud estimated at more than €100 million. The company said it was surprised by the escalation and believed authorities had misunderstood the tax treatment of its GPU cloud offering and its legacy cryptocurrency mining operations.

The Swedish Tax Agency proposed denying approximately 300 million kronor at one Northern Data subsidiary and 218 million kronor at another, figures that included potential penalties. Northern Data disputed the proposals, arguing that its activities involved providing infrastructure and services to third parties and therefore constituted taxable supplies.

HIVE's Administrative Court Losses

HIVE's dispute has advanced further through Sweden's administrative courts, with less favorable results. Its subsidiaries received a series of decisions beginning in December 2022 that rejected input-VAT recovery and required repayment of earlier refunds, with supplements and interest. The Administrative Court and Court of Appeal ruled against the company.

HIVE recognized an 822 million-kronor provision for all disputed periods through June 2026, comprising approximately 76.6 million dollars in VAT, 1.5 million dollars in tax supplements, and 6.6 million dollars in interest. The company continues to pursue multiple avenues of redress, including a July 2026 application for permission to appeal to the Supreme Administrative Court and proceedings initiated with the European Commission.

Broader Policy Context

VAT enforcement is not the only policy change affecting Swedish data centers. Sweden abolished a reduced electricity-tax rate for data centers effective July 1, 2023, after concluding the incentive was no longer appropriate. The government said electricity might need to be directed toward sectors employing more people and that removing the reduction could encourage greater efficiency. HIVE reported the change added approximately 0.30 kronor per kilowatt-hour to electricity costs at its Swedish facilities.

The region's transformation reflects a convergence of tax and energy policy. Northern Sweden attracted data centers with hydropower, cool temperatures, and reduced electricity taxes until 2023. The same industrial sites are now being marketed for AI, yet their earlier mining activity continues to generate tax assessments, appeals, and investigations.
