What the CLARITY Act Does

The CLARITY Act, formally designated H.R. 3633, proposes to clarify regulatory jurisdiction over digital assets by dividing oversight responsibilities between the Securities and Exchange Commission and the Commodity Futures Trading Commission. The legislation aims to establish clearer distinctions around which assets fall under each agency's authority.

The bill has advanced through Congress with bipartisan support. The House passed it 294-134 on July 17, 2025. The Senate Banking Committee then approved it 15-9 on May 14, 2026.

Obstacles to Passage

Several unresolved issues complicate the bill's Senate passage. Ethics provisions related to public officials holding or trading digital assets remain contested. Additionally, disputes over stablecoin yield provisions continue, reflecting disagreement over whether stablecoins should be regulated similarly to bank deposits or investment products.

Senate Cloture Vote Impact

The cloture vote requires 60 senators to advance the bill to a final floor vote. If the vote fails, the CLARITY Act would likely be shelved for the remainder of the 2026 legislative session, delaying comprehensive crypto market structure regulation into 2027 or later.
