Prosecutors in Brooklyn opened a high-profile trial against Huawei on Wednesday, characterizing the telecommunications company as a "criminal enterprise" engaged in theft, fraud, and sanctions evasion. Huawei has denied all charges.

Justice Department trial attorney Taylor Stout told jurors that Huawei spent two decades victimizing U.S. companies and abusing the financial system. Prosecutors allege the company conspired to steal trade secrets from five American companies, including Cisco router source code and T-Mobile phone-testing technology.

Huawei's legal team rejected the allegations, with attorney Brian Heberlig characterizing the case as "competition, not conspiracy." Heberlig argued that the cited incidents involved only particular employees, not the entire company, and that management took action once these situations came to light.

Iran Sanctions and Broader RICO Charges

The case has expanded into a wider racketeering prosecution. Prosecutors allege Huawei used a Hong Kong subsidiary called Skycom to procure prohibited goods from the U.S. for Iran and to transfer funds through the global banking system. According to reports, Skycom provided Hewlett-Packard products worth at least €1.3 million to Iran's largest mobile operator. HSBC approved over $100 million in transactions linked to Skycom. Prosecutors have also accused Huawei of transactions in North Korea and providing surveillance equipment used against protesters in Iran in 2009.

Huawei's Role in China's AI Chip Strategy

The timing of the trial coincides with Huawei's growing importance to Beijing's efforts to develop an independent AI chip ecosystem. Huawei's Ascend accelerator chips have become central to this initiative.

According to an April Reuters report, demand for the Ascend 950 accelerator has increased following DeepSeek's V4 launch, with interest from companies including ByteDance, Tencent, and Alibaba. Huawei plans to deliver approximately 750,000 units of the Ascend 950 in 2026. Performance assessments vary: while the chip surpasses Nvidia's H20 model, Epoch AI estimates its performance is only slightly above half that of Nvidia's H100.

Huawei faces competition from domestic Chinese rivals known as "the four little dragons": Enflame, Moore Threads, MetaX, and Biren. Enflame reported unprecedented sales growth of 1,475% in the first quarter while raising $900 million in Shanghai.

Market Share Shift and Remaining Technological Gap

Nvidia's share of China's AI semiconductor market has declined significantly from near-monopoly levels to 55%. However, this shift does not reflect technological parity. Epoch AI estimates that Huawei will produce less than 4% as much AI compute as Nvidia in 2026. High-bandwidth memory remains a critical constraint. If Huawei relies solely on Chinese-made HBM, its output could remain around 1% of Nvidia's through 2028, with chips potentially trailing Nvidia's technology by three to four years through at least 2030.

Long-Term Stakes for Global Infrastructure

The situation presents Washington with competing considerations. The Center for Strategic and International Studies notes that export controls have limited China's access to advanced technology while simultaneously accelerating domestic substitution efforts. A 2025 Bureau of Industry and Security guidance identified several Huawei Ascend chips as presumptively subject to export restrictions.

The broader implications extend globally. PwC projects $31.6 trillion in AI-infrastructure capital spending through 2050. If the U.S. and China continue building separate hardware ecosystems, the consequences could reshape where semiconductor capacity, data centers, energy investment, and AI infrastructure develop for decades.
