The proposed legislation aims to establish a comprehensive framework dividing oversight of the cryptocurrency sector between the Securities and Exchange Commission (SEC) and the Commodity Futures Trading Commission (CFTC). For XRP, certain regulatory questions were previously addressed when the SEC identified digital commodities—including XRP, Bitcoin, Ethereum, Solana, and Cardano—as assets whose value derives from underlying networks and supply-and-demand dynamics rather than the managerial efforts of others.

Despite high expectations, the Senate will not vote on passing the CLARITY Act itself on September 15. Instead, lawmakers will vote on cloture on the motion to proceed to H.R. 3633, a procedural measure requiring 60 votes to advance the legislation toward formal Senate consideration.
A failure to move forward could potentially derail the bill's prospects for the year. Recent reports indicate that legislative odds have declined from over 70% to roughly 30% over recent months. While the National Sheriffs' Association recently dropped its opposition and moved to a neutral position, reports have highlighted unresolved ethics disputes and political hurdles that could impact the vote.
