The Commodity Futures Trading Commission has moved a new crypto rulemaking into White House review, marking a formal step toward establishing clearer rules for digital asset trading in the United States.
The Office of Information and Regulatory Affairs lists a CFTC submission under RIN 3038-AF80 titled "Regulation Crypto Asset Transactions and Regulation Crypto Asset Markets." The filing was received on September 17 and remains under review.
Current Stage of Development
The submission is classified as a pre-rule and has not yet been finalized. This means the proposal is still undergoing executive-branch review before the public sees the full details of the CFTC's intentions.
No new trading permissions have taken effect, no compliance deadlines have been set, and no automatic changes to how exchanges can offer derivatives to U.S. customers have occurred at this stage.
Implications for the Industry
The CFTC already oversees futures, options, and other derivatives markets. Crypto firms have long sought clarity on how products such as perpetual-style contracts fit within existing U.S. regulations. A formal rulemaking could help clarify some of the regulatory uncertainties that have characterized the space.
The agency has already addressed crypto market structure through guidance and no-action positions earlier in the year. A broader rulemaking could consolidate this work into a more durable regulatory framework.
Key details that may emerge from the final proposal include margin requirements, eligible participants, exchange registration standards, clearing procedures, and the treatment of leveraged retail products. These elements will likely determine whether more crypto derivatives activity can migrate into regulated U.S. venues.
