CLARITY Act Faces Uncertain Future After Failed Senate Cloture Vote

The CLARITY Act, a proposed digital asset market structure bill, failed a Senate cloture vote on Tuesday, receiving 49 votes when 60 are required to advance legislation. However, the bill's prospects are not entirely exhausted.

Republican Senator Thom Tillis switched his vote from yes to no on procedural grounds, a parliamentary maneuver that allows him to file a motion to reconsider and preserve a route back to the Senate floor during the current legislative session.

According to Ryan Eagan, director of US federal affairs at the Crypto Council for Innovation, Tillis's motion to reconsider would provide an opportunity to revisit CLARITY's cloture vote at any point this session, though specific timing for next steps remains unclear.

Timeline Pressure

The Senate is scheduled to recess on October 2 before returning after the midterm elections, and the House of Representatives has already recessed. This compressed timeline presents a significant obstacle to advancing the legislation before year's end.

Congressman Shri Thanedar, a Democrat who supported CLARITY when it passed through the House in July 2025, characterized the remaining legislative calendar as a "major barrier" to reaching an agreement, noting there are only 20 legislative days left in Congress, all after the midterms.

The crypto industry has precedent for a comeback. The GENIUS stablecoins bill failed a cloture vote 48-49 in May 2025 but cleared a second cloture vote 66-32 just 11 days later and subsequently passed the Senate. However, Kyle Chassé, founder of crypto investment firm MV Global, cautioned that GENIUS "had a deal" whereas CLARITY currently has neither.

Partisan Divide

All 49 votes for CLARITY came from Republicans; no Democrats voted to advance debate on the bill. Yet seven Democratic senators stated Wednesday they "remain committed" to enacting the legislation, signaling willingness to continue negotiations.

Senator Angela Alsobrooks stated she was "ready to strike a deal" and willing to negotiate over ethics provisions, saying "it's clear that now is the time to regulate digital assets." She alleged that Republican leadership shut down discussions at the last minute.

Senator Tillis indicated his goal is to "convince the Democrats to get on board" and stated he feels "very strongly that this is an unregulated marketplace and that we need some guardrails on."

Points of Contention

Republicans had already made 126 substantive changes requested by Democrats before Tuesday's vote, including tighter restrictions on public officials profiting from crypto ventures and a role for state attorneys general in enforcing ethics provisions.

Thanedar acknowledged the failed vote demonstrates "that a more bipartisan drafting process would lead to a higher likelihood of creating the bipartisan, supermajority coalition that passing this legislation into law would require."

Key sticking points include ethics provisions related to President Trump's crypto interests, stablecoin yield restrictions, illicit finance oversight, and developer protections for non-custodial wallet creators. Chassé suggested the industry prioritize protecting self-custody and developer safeguards while being more flexible on other provisions.

Regulatory Action Continues

Even if CLARITY stalls in Congress, US crypto regulation continues through agency action. The Securities and Exchange Commission and Commodity Futures Trading Commission have demonstrated commitment to reducing regulatory uncertainty through guidance, rulemaking, and relief mechanisms, according to Eagan.

However, regulatory guidance can change with administrations, whereas legislation is more difficult to reverse. The GENIUS Act implementation continues at Treasury and banking regulators independent of CLARITY's status.
