The European Commission's review of cryptocurrency markets is examining whether staking has grown large enough to require its own regulatory framework. Item 66 of the MiCA review consultation, which remains open until September 30, asks whether Europe's current treatment of staking is adequate and what requirements should apply to staking service providers.

While no proposed staking license or final policy position has been announced, the question signals regulatory direction. The European Commission explicitly states that the consultation document is not a final policy position, but regulators are clearly considering whether staking has become complicated enough to warrant treatment as a distinct regulated service.

Current Regulatory Status

Staking already falls partially under MiCA's existing framework. Direct staking—where users lock assets themselves—requires no MiCA authorization. However, when companies provide staking-as-a-service by taking custody of customer assets or controlling keys, the activity falls under MiCA's custody and administration rules, according to ESMA guidance.

MiCA already imposes obligations on custodians holding client crypto, including written agreements, asset separation from firm holdings, and procedures protecting customer ownership rights in insolvency. ESMA has additionally prohibited custodians from staking customer assets for their own benefit.

The scope of staking has expanded significantly. An EBA and ESMA joint report estimated liquid staking at $44 billion in October 2024, with nearly 80% on Ethereum. Lido alone represented roughly $25 billion of that value at the time.

Potential Regulatory Changes

A dedicated staking framework could introduce new requirements addressing risks regulators have identified. These could include:

  • Clear disclosure of who bears losses if validators are slashed
  • Formal withdrawal terms and timeframes
  • Explicit explanation of how providers select validator operators
  • Separation of protocol issuance, validator performance, and fees in reward advertising
  • Enhanced documentation of validator selection and operational procedures

Regulators could require providers to spell out in advance whether customers or providers absorb losses from validator penalties, and clarify how quickly unstaking requests will be processed.

Compliance and Market Effects

Additional regulatory layers would create different impacts across the industry. Large exchanges and banks with existing MiCA authorization could absorb staking-specific compliance costs by adding policies to current operations. Smaller validator businesses may face a more difficult decision, as new requirements for regulatory reporting, legal work, insurance, and infrastructure could make European operations unviable.

Some smaller providers may exit European markets, cease direct customer service, or operate exclusively through licensed custodians. This consolidation could concentrate staking through major exchanges and banks acting as regulated intermediaries, fundamentally changing how validator selection and delegation occur.

For proof-of-stake networks, this represents a network security consideration because validator distribution affects consensus mechanisms. More regulation could increase consumer protection while concentrating decision-making within firms large enough to afford regulatory compliance.

Historical Parallels

Similar regulatory transitions have reshaped financial products. Following SEC reforms to money-market fund rules in 2014, roughly $1 trillion migrated from prime funds to government funds by the 2016 implementation deadline, according to Federal Reserve data. Users did not abandon money-market funds; they moved toward the product versions that aligned with new regulatory requirements.

Staking could follow a comparable path. If custodial staking becomes more expensive and prescriptive, users might migrate to large providers capable of absorbing costs, shift toward self-custody arrangements, or accept product redesigns aligned with regulatory boundaries.

Regulatory Trade-offs

Enhanced regulation addresses real issues. When exchanges take customer assets, select staking validators, and experience operational errors or withdrawal delays, current rules may prove insufficient. However, staking is not merely a financial service—it is a core mechanism through which proof-of-stake blockchains maintain security and reach consensus.

Treating staking too extensively as a conventional investment service risks converting part of network security into regulated asset management. As staking evolved from technically sophisticated independent users running validators to major exchanges offering one-click staking to millions of customers, regulatory demand increased substantially.

The outcome of the Commission's review remains undecided. If Brussels establishes dedicated staking rules, staking will have completed a familiar transition: from unfamiliar technical mechanism to commercial product to a regulated industry where authorities determine who can provide services and under what conditions. This may enhance consumer safety but could also increase costs, concentrate infrastructure, and move staking further from permissionless origins.
