The National Sheriffs' Association announced this week that it is changing its position on the crypto Clarity Act from opposition to neutral, citing the complexity of the legislation.

In a letter to Senate Majority Leader John Thune and Minority Leader Chuck Schumer, NSA President Sheriff Troy Wellman and Executive Director Justin Smith stated: "Given the complexity of the legislation and the number of important details that remain under consideration, the NSA is changing its position on the Clarity Act to neutral."

The association previously warned that the bill could create regulatory and anti-money laundering loopholes by exempting certain crypto developers and infrastructure providers from money transmitter rules. However, the organization indicated it would allow the legislative process to proceed.

Bill Details and Timeline

The Clarity Act establishes a framework for distinguishing between digital assets that are securities, commodities, or payment stablecoins. The legislation passed the House of Representatives last year with bipartisan support but has faced delays in the Senate throughout 2026.

A Senate vote is scheduled to proceed this month after lawmakers had initially hoped to vote in August. An updated version of the bill was introduced in July, which included provisions banning government officials and their families from issuing or promoting cryptocurrency.

Pro-crypto senator Cynthia Lummis stated that the "bipartisan bill" gives "law enforcement real tools to fight the illicit finance crimes hurting hard working Americans."

Major financial institutions, lawmakers, and companies have expressed support for the latest draft. However, the bill has faced obstacles from the banking lobby, which raised concerns over stablecoin yield, and some lawmakers have called for improvements regarding ethics. Some Republicans have accused Democratic lawmakers of deliberately delaying the measure.
