The Clarity Act is set for its first Senate floor test Tuesday, requiring 60 votes to invoke cloture and proceed toward formal debate. The vote comes after over a year of Senate negotiations and more than five years of congressional efforts to pass comprehensive crypto market structure legislation.

Senate Republicans released updated text Sunday evening incorporating what they describe as 126 substantive changes addressing Democratic concerns. The revised draft includes modifications to ethics provisions, software developer protections, agricultural title language, and a new stablecoin "circuit breaker" mechanism intended to address community bank deposit concerns.

Late Monday, Senate Democrats submitted a counteroffer requesting additional changes. Democrats are seeking tighter restrictions on large crypto holdings, dependent children involvement, and paid crypto promotions in the ethics section. They also want further modifications to the Blockchain Regulatory Certainty Act to narrow its scope and clarify that it does not modify criminal law, plus tighter rules in the agricultural title around exchanges, conflicts of interest, and Tribal gaming law protections.

Republicans characterized the Democratic response as moving beyond agreed compromises. "In response to a significant step in their direction, Democrats have chosen to move the goalposts again," said Senate Banking Committee spokesperson Jeff Naft. "Republicans made 126 substantive changes at Democrats' request, including major changes to address their ethics concerns."

Several key Democrats have expressed concerns about the ethics language. Senator Elizabeth Warren has argued the new ethics provisions give Trump administration officials excessive control over enforcement and contain loopholes permitting the president to profit from existing crypto interests. Senators Mark Warner, Ruben Gallego, and Raphael Warnock have also stated the ethics proposal requires further work.

The banking industry has intensified opposition to the stablecoin provisions. Eight banking trade groups, including the American Bankers Association and Independent Community Bankers of America, stated Monday that the circuit breaker mechanism is "not a safeguard at all" because it would only activate after substantial deposit flight has already occurred. The groups renewed calls to tighten stablecoin rewards language to eliminate potential interest-like payments on stablecoin balances.

The White House Crypto Council rejected banking concerns, with Executive Director Patrick Witt describing the latest Republican text as a "best and final offer" and suggesting only "punctuation or technical changes" remain. The Council of Economic Advisers released an interactive tool Monday allowing users to test the banking industry's deposit flight argument, building on earlier analysis finding "no meaningful relationship between stablecoin growth and community bank deposit flight."

Republican support remains uncertain. Senator John Curtis said he would vote to advance the bill but opposes final passage due to banking concerns. Senators John Cornyn and Susan Collins indicated they were still deliberating their positions. The return of Senator Mitch McConnell to the Senate Monday night after a three-month absence may assist Republicans with vote counts.

White House officials acknowledge the vote outcome may depend on political rather than policy considerations. Senator Kirsten Gillibrand has privately urged Democratic colleagues to vote to advance the bill and continue negotiations on the Senate floor.
