The artificial intelligence industry's push for federal regulation may have triggered an unintended consequence. Major AI companies have sought government oversight in recent months, but rather than creating the protective regulatory framework they anticipated, lawmakers are now considering far more stringent measures.

Leading frontier AI labs, particularly Anthropic, have emphasized safety concerns and called for strict regulations. Critics argue this strategy aims to establish a regulatory moat that would be too expensive for smaller competitors to navigate, effectively locking in the dominance of well-capitalized incumbents.

However, Congress has responded more aggressively than the industry expected. Senator Bernie Sanders and Representative Greg Casar introduced the Ban Artificial Superintelligence Act on September 3, which would prohibit the development of systems matching broad human cognition or capable of resisting shutdown. The legislation proposes criminal penalties including up to 20 years in prison for developers who build unapproved AI systems and suggests a permanent bar on superintelligence development until a new cabinet-level agency establishes rules.

Sanders has also proposed requiring a 50% public equity stake in major AI companies to fund a $7 trillion public pool. Such a measure would represent significant government control over the industry's most valuable private companies.

Complicating the landscape further, Anthropic CEO Dario Amodei recently acknowledged the unusual nature of private control over advanced AI technology. In a CBS interview, he stated that private companies building this technology has "always been very strange" and expressed personal discomfort with the arrangement, effectively validating the premise behind legislative proposals to increase public control.

The regulatory environment remains uncertain. On September 13, President Donald Trump dismissed AI safety warnings and rejected moratorium proposals, instead framing artificial intelligence development as a geopolitical competition with China. Trump stated that "whoever wins AI wins," positioning the sector as a race rather than a domain requiring restraint.

The industry now faces divergent potential futures: continued dominance under strict incumbency-protecting regulations, seizure of equity stakes through public wealth funds, or unrestricted development driven by geopolitical competition. The outcome of the regulatory debate will significantly shape the technology sector's structure and governance in coming years.
