The cloture vote will determine whether the bill advances. Republicans control 53 seats and need at least seven Democratic votes to reach the 60-vote threshold required for passage.

Central Point of Disagreement: Ethics Rules

The primary sticking point involves ethics provisions that would restrict senior government officials from issuing or promoting certain crypto tokens. The proposed language would apply to the President, Vice President, and other key officials.

A significant controversy centers on whether the ethics rules should extend to officials' children. The current proposal does not apply ethics restrictions to children, a distinction that has drawn scrutiny given connections between the Trump family and World Liberty Financial, a crypto firm that recently received a bank charter for a USD1 stablecoin in August.

Unresolved Issues and Vote Count

The Democratic caucus has been working on amendments for months, but numerous issues remain unresolved. Senator Rand Paul opposes the bill, and Senator Josh Hawley has expressed doubts. Republican Senator Thom Tillis has warned that the CLARITY Act might not pass if the ethics dispute is not resolved, positioning him as a potential swing vote.

Senator Kirsten Gillibrand, a pro-crypto Democrat, has called for stronger ethics safeguards. Several other pro-crypto Democrats remain undecided.

Previous Action and Timeline

The CLARITY Act previously passed the House with bipartisan support and cleared the Senate Banking Committee in May. If the bill fails in Tuesday's vote, Senator Cynthia Lummis warned it could be delayed until 2030. The proposed legislation includes an expiration date of 2029.

The regulations would not prevent officials from holding crypto assets in their individual names and would allow other activities such as licensing deals and paid appearances at crypto events.
